Data Protection

It is of highest importance for DocApp to protect the personal data of the users of www.docapp.ch (online doctors search platform). As a matter of course, DocApp meets the legal data protection regulations. Subsequently end users (patients) and providers (medical service providers) get an overview of how DocApp guarantees the data protection and which data are being collected and processed. This data protection policy shall apply for all mobile (smartphone, etc.) or statistical (desktop, etc.) accesses on DocApp and for all services offered by DocApp, both now and in future (see General Terms and Conditions).

What is DocApp?

 

The online doctors search platform (www.docapp.ch) DocApp is on the one hand a contact and information platform for end users and patients (“user“) and on the other hand a platform for medical service providers (doctors and dentists) und providers, such as doctor’s offices, clinics, etc. (“provider“), which offer outpatient and inpatient services for patients. The aim of DocApp is to support “users” in the online search of the right “providers”, i.e. medical service providers registered in Switzerland. For this purpose, DocApp provides the “users” information, in order to be able to contact the right “providers” for a potential appointment request and service provision.

 

Data Protection on DocApp

 

DocApp collects personal data of the service providers, which are listed in the register, in the framework of the use of DocApp by end users, in particular the number of profile visits and requests for the medical service provider’s contact data. The purpose of collecting the personal data and reviews of the service providers is to develop an index of relevance and content for end users.

 

For this purpose, DocApp intends to publish the profile visits and reviews, provided by end users. The publication and the information about the profile visits are anonymised with regard to the user, the service providers, however, are being identified. Profile visits get published on DocApp, except the case, that a service provider demands explicitly the deletion from the register.

 

Each service provider can (after his identity has been checked sufficiently) question his “amount of profile visits” and demand from DocApp not to publish it. He can also demand from DocApp, to permit him see the data archived in the system.

 

1) Data collection, processing and use

 

As soon as users access the online doctors search platform DocApp, the following data are being saved on the server for the purpose of data protection: the IP address of the computer, which the site requires, time, status, transferred data volume, the website, from which the user accessed the requested site and product and version information of the used browser. These data do not get evaluated, except for internal statistic purposes and in an anonymised form.

 

Moreover, in the framework of the use of the online doctors search platform, the following user’s data are being collected, saved, processed and used:

In the course of the search query: question text, description of the symptoms, health problem, searched discipline, place of treatment and region. Furthermore, the following data are being registered in case of a date inquiry: first name, surname, age, sex, telephone number, email address for the appointment confirmation and optional data for insurance coverage. DocApp exclusively uses these data for the processing of the individual search or for a non-binding recommendation of medical specialists. As far as personal data are being collected, the data transfer is secured via SSL encryption against unauthorised access. At the same time, DocApp respects all current data protection laws in Switzerland.

 

2) Cookies

 

As most of the websites, DocApp uses session cookies to gain information about how the website is being used. Users can prevent the installation of cookies by means of an appropriate configuration in the browser software.

 

3) Counting of page views

 

As web analysis service, DocApp uses Google Analytics, a web analysis service of the Google Inc. (“Google”). This service uses cookies. The information, generated by the cookie, about the use of this website, is partially being transferred to a server of Google in the USA und saved there. This information is being used to compile reports for DocApp about the website activities. Google will possibly transfer this information to third parties, as far as this is prescribed by law or as far as the third parties process the data on behalf of Google. By using the website of DocApp, users agree with the processing of the collected data by Google in the way and purpose described above. As explained in section “cookies”, the data collection by Google can be prevented by means of an appropriate configuration in the browser software.

 

4) Re-Targeting-Technologies

 

DocApp uses a Re-Targeting-Technology. These technologies are being used by DocApp, in order to design the Internet offering more interesting for end users. This technique enables us to address Internet users, who have already been interested in our service, on our partners’ websites by means of advertisement. We are convinced that showing a personalized, interest-related advertisement is normally more interesting for the Internet user than advertisement without such a personal connection.

 

The display of advertising materials on our partners’ sites is based on a cookie-based analysis of the previous usage behaviour. As a matter of course, neither person-related data are being saved, nor are usage profiles being joined with your person-related data. The use of the Re-Targeting-Technology is being carried out respecting the current legal data protection regulations.

 

5) External social networks

 

DocApp contains references (links) to the external social networks Facebook, Twitter, Google+, LinkedIn and Xing. If you follow this social media link via mouse click, the Plugins are being activated and the browser establishes a direct connection with the respective servers of the brands mentioned above. As far as end users follow the links, when they visit the website, and are logged in on one of these services with their personal user account, the information of the visit is being processed in the system. In order to prevent this, end users have to log out from their accounts before clicking on the link. The functions assigned to the links, especially the transfer of information and user data, get activated as soon as you click on the respective link, not already by visiting the website of DocApp. Please refer to the data protection notices of the respective providers for the purpose and extent of the data collection by social media providers, the local further processing and use of the data as well as the rights and configuration options concerning this matter for the protection of your privacy.

 

6) Summarizing declaration of consent

 

By using DocApp (www.docapp.ch), the user agrees with the collection, saving, processing and the transfer of personal data to the extent, described in this DocApp data protection policy. Furthermore, the DocApp user agrees, that so-called cookies and possible third-party providers are used, so that the usage data are being collected, saved and used to an extend according to the data protection policy. The user can revoke his approval for cookies at any time, by adjusting the browser settings accordingly.

 

7) Data security and right to information

 

DocApp uses appropriate technical and organizational security measures, in order to protect personal data, which has been saved by us, against manipulation, partial or complete loss and against unauthorised third-party access. The safety measures are continuously being improved according to the technological development. DocApp also takes internal data protection within a company very seriously. Our employees, partners and service companies assigned by DocApp, have been bound to secrecy and to the compliance with the data protection regulations. The end user can demand information from DocApp about the saved data, which is related to his email address and person.

 

8) Amendments of the data protection policy

 

DocApp Switzerland AG reserves the right to change its data protection policy in the course of the further development of the online doctors search platform and the activities and services involved, at any time and without giving reasons. In case of extensive changes or additions of the data protection policy, end users get informed about the modified passages in a suitable manner. They come into force after the expiration of the deadline mentioned in the notification.

 

9) Applicable law/ place of jurisdiction

 

Swiss Law is applicable to all contractual relationships between the DocApp Switzerland AG and end users, patients and medical service providers, except of the Private International Law, with reservation of contrary, compelling statutory provisions.

 

Exclusive venue for all disputes resulting from this contractual relationship is Zurich, with reservation of possible compelling places of jurisdiction.
